 Legal Information THIS AGREEMENT (“Agreement”) is made between Lease2You.Com, LLC (“Company”) and any person (“User”) who advertises or seeks rental property using Company’s interactive online real estate advertising service website (“Site”).
BY CLICKING THE ACCEPTANCE BUTTON OR ACCESSING, USING OR INSTALLING ANY PART OF THIS SITE, USER EXPRESSLY AGREES TO AND CONSENTS TO BE BOUND BY ALL OF THE PROVISIONS OF THIS AGREEMENT. IF USER DOES NOT AGREE TO ALL OF THE PROVISIONS OF THIS AGREEMENT, THE BUTTON INDICATING NON-ACCEPTANCE MUST BE SELECTED AND, IN SUCH INSTANCE, USER MAY NOT ACCESS, USE, INSTALL, RELY, OR BENEFIT FROM ANY PART OF THIS SITE.
- Termination. This Agreement is effective upon User’s acceptance as set forth herein and shall continue in full force until terminated. User may terminate this Agreement for any reason upon thirty (30) days prior notice to Company. Company reserves the right, in its sole discretion and without notice, at any time and for any reason, to: (a) remove or disable access to all or any portion of this Site; (b) suspend User’s access to or use of all or any portion of this Site; and (c) terminate this Agreement.
- Services and Prices. The prices and complete descriptions of this Site, including all of Company’s advertising packages, services, and products are posted on Company’s “List My Property” page.
- No Professional Services. Company is not providing or attempting to provide any real estate, appraisal, legal, or other professional services. Company is engaged in providing rental property advertising services only. The acceptance of this Agreement by any User shall be an unconditional acknowledgment that each User shall have obtained any desired real estate, appraisal, legal, or other professional services or assistance.
- Disclaimers of Warranties. Company is publishing this site and its advertising content without warranty of any kind whatsoever, and makes no representations whatsoever, express or implied, regarding the accuracy, completeness, or otherwise as to the content of the site and the advertisements. COMPANY DOES NOT WARRANT THAT THIS SITE WILL BE UNINTERRUPTED OR ERROR FREE. COMPANY DOES NOT MAKE ANY WARRANTY AS TO ANY RESULTS THAT MAY BE OBTAINED BY USE OF THIS SITE. COMPANY MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, IN RELATION TO THIS SITE. Company publishes ads without editing or review as to content accuracy or completeness and does not undertake to verify the accuracy nor completeness of ads. Company does not perform any verification of THE accuracy or completeness OF ANY advertising content. Likewise, Company has not and does not undertake to verify the completeness nor accuracy of the content of any third party website which is referenced on this site nor any content provided in this site. All such references to third parties, their websites, and this site’s content provided by any third parties is for the user’s convenience and it is the user’s responsibility to evaluate the accuracy and completeness of such third party content or website.
- Limitation of Liability. under no circumstances shall Company or it is owners or any of their officers, directors, employees or agents be liable to User or any other person for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the use of this site or any third party website referenced herein. This is a complete limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. IF USER IS DISSATISFIED WITH THIS SITE, USER’S SOLE AND EXCLUSIVE REMEDY SHALL BE FOR USER TO DISCONTINUE USE OF THIS SITE AND TERMINATE THIS AGREEMENT. - Indemnification. By using this Site, User agrees to indemnify, defend, and hold harmless Company, its and their officers, directors, employees, affiliates, agents, licensors, and suppliers from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from User’s use of this Site or any breach by User of this Agreement.
- Modification. Company reserves the right, at its sole discretion, to modify the contents of this Site at any time without notice. Price and availability of any or all of Company’s services or products, including the publishing of this Site in its entirety are subject to change without notice.
- Refusal and Discontinuance. Company reserves the right to refuse to publish or to discontinue publishing any advertisement in Company's sole discretion. Prepaid advertising will be refunded pro-rata only in the event the entire publication of this Site ceases.
- Permitted Use. This Site is proprietary to Company and is protected by intellectual property laws and international intellectual property treaties. User’s access to this Site is licensed and not sold. Subject to the timely payment of all fees and the provisions of this Agreement, Company agrees to provide User with personal, non-transferable and non-exclusive rights to use this Site. Permission is granted to use this Site and its contents for the sole purpose of advertising or seeking rental property. Users may copy only those portions of this Site's advertisement content which is of assistance to said Users for the sole purpose of pursuing their leasehold real estate transactions. Any other use of the information and material on this Site, including without limitation, reproduction for purposes other than those listed above, modification, distribution, or republication without prior written permission of Company is strictly prohibited unless specifically requested by Company. Use of this Site for the purpose of gathering information either for use of any kind or for republication (unless specifically requested by Company) or SOLICITING the advertisers for commercial or other purposes is EXPRESSLY PROHIBITED. Company reserves the right, and all Users expressly consent to these procedures, to employ such procedures as it deems necessary to detect any unauthorized solicitation of advertisers or information gathering. In addition to and without limiting any other legal remedy available to Company either at law or in equity, in relation to its enforcing this non-solicitation/information gathering provision, it is expressly stipulated that all gross revenues along with all other commercial benefits accruing to any solicitor/information gatherer violating this restriction shall be the property of Company and Company shall be entitled to its attorney fees and cost associated with any legal proceeding brought to collect said revenues or benefits in the event they are not remitted to Company immediately upon receipt of same by any such violating solicitor/information gatherer.
- Refunds. Except as expressly set forth herein, no refunds shall be made for advertising.
- Right to Block Access. Company expressly reserves the right, in its sole discretion, to block access to this Site to any User.
- Privacy. The Company is very sensitive to privacy issues. Any information gathered from this Site, including addresses, operating systems, and browser software types will be used to reflect the population as a whole rather than focusing on individuals, and will strictly be used to improve Company’s marketing and promotional efforts, to statistically analyze usage of this Site, to improve Company’s content and product offerings and to customize the content of this Site. No identifiable information such as names, phone numbers or e-mail address will be given to the public. However, Company reserves the right to amend this privacy policy from time to time. Company will display on this Site any substantial change in the way personal information is being used. Company automatically stores the following information about Users: (a) the Internet Protocol Address and domain name; (b) the type of browser and operating system; (c) the date and time Users used this Site; (d) the web pages or services accessed at this Site; (e) the website visited prior to coming to this Site; (f) the website visited upon leaving this Site; and (g) any information that may be downloaded. - Links. This Site may contain links to other websites that may collect personally identifiable information about Users. When Users click on one of these links, Users may enter another website for which the Company has no responsibility. Furthermore, the provisions of this Agreement do not cover the information practices or policies of such websites. Users are encouraged to read the privacy policies of all such websites, as their policies may be materially different from this Site.
- Governing Law. This Agreement is made in and shall be governed by the laws of the State of Arkansas without reference to conflicts of laws.
- Forum. All actions, claims or disputes arising under or relating to this Agreement shall be brought in the federal or state courts in the State of Arkansas. The parties irrevocably submit and consent to the exercise of subject matter jurisdiction and personal jurisdiction over each of the parties by the federal and/or state courts in the State of Arkansas. The parties hereby irrevocably waive any and all objections which any party may now or hereafter have to the exercise of personal and subject matter jurisdiction by the federal or state courts in the State of Arkansas and to the laying of venue of any such suit, action or proceeding brought in any such federal or state court in the State of Arkansas.
- User Acceptance. The use of this Site shall constitute acceptance of the provisions of this Agreement. Company may amend this Agreement by posting any change on this Site.
USER HAS READ, UNDERSTANDS, AND AGREES TO THE PROVISIONS OF THIS AGREEMENT.
COMPANY IS PLEDGED TO THE POLICY FOR THE ACHIEVEMENT OF EQUAL HOUSING OPPORTUNITY THROUGHOUT THE UNITED STATES OF AMERICA.
